Within the scope of the 2nd Law for the  Adaptation of Maritime Regulations from 16 June 2002 (Federal Law Gazette I S. 1815) the Maritime Safety Investigation Law has entered into force as his article 2 on 20 June 2002.

Para 15 intends a suitable validity of numerous regulations of the Law Relating to the Investigation into Accidents and Incidents Associated with the Operation of Civil Aircraft, dated August 26 th and is for this a row of conceptual correspondences.

In order to facilitate the raising and application of the regulations, herewith an impression of the totality of the regulations is published as a reading help.

Ship Safety Law

extract:

§ 1 Purpose and scope

(1)   This law aims at the uniform and effective implementation of valid international Ship Safety Regulations for the safety at sea including labour protection of persons employed on seagoing vessels and protection of the marine environment directly connected with it.It applies to all seagoing shipping.

(2)   International Ship Safety Regulations in the sense of this law are the provisions of domestically applicable international law listed in sections A to C of the Annex and the legal acts of the European Communities listed in section D of the Annex in their versions as mentioned.

International Ship Safety Norms in the sense of this law are the provisions listed in section E of the Annex published in Germany as applicable recognised technical rules or as seafaring practice in their versions as mentioned.

§ 7 Regulation on Securing Shipping Reporting of certain incidents causing damage or dangers

extract:

(1) The Master of a vessel flying the Federal German Flag, or if he is prevented another crew member, or if none of these persons is in a position to do so, the operator of the vessel, shall notify the Federal Bureau of Maritime Casualty Investigation promptly of every incident relating to the vessel causing damage or danger in the meaning of Para. 2 and if possible transmit the following data: (....)

(2) An incident in the meaning of Para. 1 is every event during operation of the vessel in shipping, if due to the operation

1. a person is seriously or fatally injured or missed, or the crew is substantially endangered,

2. a) the vessel sustains damage due to grounding, collision, fire, weather or explosion or

b) failures occur in a system that (is important) for the stability or safety journey necessary is and as a result which the safe navigation is impaired or was impaired, or

3. substantial endangerment of or damage to the marine environment has occurred.
